These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “Customer”, “User”) and Novelty Gardening Seeds (“we”, “us”, “our”, the “Company”), located in New Minas, Nova Scotia, Canada. By accessing or using our website, placing an order, or engaging in any transaction, you agree to be bound by these Terms. If you do not agree, do not use our services or place orders.
1. Use of the Website and Products Our website and all products (seeds) are provided for lawful purposes only. All seeds are sold strictly as novelty items for collectors, ornamental, or educational use. We do not guarantee, represent, or warrant that seeds are suitable for consumption, medicinal use, cultivation for any prohibited purpose, or compliance with local laws outside Canada. You are solely responsible for ensuring your purchase and use comply with all applicable laws in your jurisdiction. We disclaim any liability for legal issues arising from your purchase or use or our Novelty Seeds.
2. Orders and Acceptance All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order (in whole or in part) at our sole discretion, including for suspected fraud, pricing errors, unavailability, or any other reason, without liability. Order confirmation does not constitute acceptance; acceptance occurs upon shipment.
3. Payments All payments are billed in Canadian Dollars (CAD), including orders from the USA, UK, and Europe.
Example: If you are billed for 28.50 in Canadian dollars, this will equal the exchange rate that you have selected. Approx: 25.00 Canadian will equal $18.07 US Dollars. This changes daily. If you see your bill go up on your bill receipt compared to what’s shown on the website, this is due to the exchange rate in your country. However, what you see on the website is what you will be billed on your payment method.

Payment Types We Accept:
- e-Transfers – Canada
- Credit Cards – United States, Canada, UK, EU
- Bitcoin & Other Coins – Worldwide (Buy Bitcoin in minutes with Debit, PayPal, and CC in the USA and Canada with Coinbase)
e-Transfers All payments for e-transfers in Canada can be sent to payments@noveltygardeningseeds.com. No matter what your security question is, the security answer must be “noveltyseeds1” without the quotes.
Credit Card Payments We accept Credit Cards on our payment page. Credit Card payments will show on your Credit Card Statement as Novelty Gardening Seeds.
Attention USA/International Customers: If you are in the USA or an international customer, you will need to enable international transactions on your Credit Card, or it will be declined. We accept American Express, Diners Club, Discover, EnRoute, JCB, MasterCard, and Visa for payments. We only ship to the name and address of the Credit Card holder; all others will be cancelled without reason or notice. (We may make exceptions for partners such as husband/wife with the same last names and addresses.)
Once your Credit Card payment is approved by us and cleared by our payment provider, we will then ship your order. This can take up to 24 hours for the payment to clear, or more if your order was received on the weekend or holiday (typically this only takes a few hours depending on time of day). Once the payment is approved, you will get a notification from our messaging system that your order is being processed. Once your payment has cleared (normally in the evening the same day), your order will ship within 48 to 72 hours (excluding weekends and holidays).
If you decline the payment after the fact without notice to us, your payment will be cancelled as well as your order. You will most likely be added to our banned buyers list. If there is an issue with the Credit Card used for payment, we will contact you through our system or by email. Chargebacks or cards reported stolen will result in the customer being added to our banned customers list, and their details may be shared with our collections partners in the US and Canada. We fight all chargebacks; your information will be shared with our payment processor (including but not limited to addresses, emails, names, order dates, order details, card details, etc.). We reserve the right to cancel any order we deem fraudulent or predatory without contact or reason.
Bitcoin Payments We have a built-in payment system for Bitcoin and other coin payments. You can buy Bitcoin in the US using Coinbase (Preferred), PayPal, Zelle Pay, and Bank Transfer. Once we receive Bitcoin payment confirmation for your Novelty Gardening Seeds order, we will ship your seeds.
- Orders must be paid for in full before any goods will be shipped.
- You will be charged in CAD (Canadian Dollars).
- Due to currency conversion and rounding, the amount you see on the screen will usually be slightly different from the amount on your statement.
- Customers are responsible for bank transfer charges.
- Please note, only one discount/coupon code applies per order.

4. Shipping and Delivery To ensure the quickest possible delivery, your order will be shipped discreetly from Canada. Free shipping to the USA, Canada, and Europe on orders over $150.00 Canadian (not valid with coupons under $150, does not include express shipping). We charge a flat shipping fee per order, regardless of the number of seeds you buy. For complete peace of mind, we strongly recommend taking advantage of additional Guaranteed Delivery Insurance (available for Canada and USA only) and Extra Safe Shipping options.
These options can be waived by us if you have provided us with an undeliverable shipping address (it must be your real name and real address). We deliver our seeds to the USA, Canada, and Europe; however, we strongly advise you to check regulations regarding seeds in your country prior to ordering, as we will not be held responsible for any legal problems resulting from your purchase. All our seeds are sold as novelty items.
Make sure your NAME & ADDRESS IS CORRECT. We are not responsible for incorrect addresses—remember things like your apartment number, rural routes, extra street information, etc. Our orders are one-way only; this means once they are shipped, if your address is incorrect, your order will be lost, and we are not responsible. We expect you to know it and provide it correctly to us for shipping your order.
Shipping Times and Costs We charge a flat fee for every order, and we offer FREE DELIVERY for all orders above CA$150 in Canada and USA (must come to $150 after coupon; regular shipping)! We typically ship your order in 48 to 72 hours (not including weekends and holidays). We need time to pack your order. You will get a notification from our system once your order has been posted. It may also take time for the postal service to pick up your order from our mailbox.
Delivery times will vary depending on your location, holidays, weekends, etc. We are not responsible for the postal services. Messaging us repeatedly about where your order is will most likely go unanswered. Repeatedly messaging us about an order will not make the postal system ship them faster. If the postal system is taking time to deliver your order, your issues are with them.
All sales are Online, we do not have a storefront.
ALL SHIPPING PRICES IN CANADIAN DOLLARS Canada – In typical circumstances, it should arrive within 5 – 15 business days (please allow 30 days for delivery).

- Tracked Shipping: $23.00
- Express Shipping: $35.00
- FedEx Ground Shipping (Fastest: 4 to 7 Days): $55.00
United States – In typical circumstances, it should arrive within 5 – 16 business days (please allow 30 days for delivery).
- Tracked Shipping Cost: CA$17.50 (About $12.50 in US Dollars after Exchange)
- Express Shipping: CA$40 (About $29.00 in US Dollars after Exchange)
- FedEx Ground Shipping (Fastest: 5 to 10 Days): CA$55.00 (About $40.00 in US Dollars after Exchange) (excluding Hawaii and Alaska)
Europe (United Kingdom) – Please allow 10 – 25 working days for delivery (please allow 30 days for delivery). Tracked Shipping Cost: CA$35, Express Shipping: CA$55.
Order Tracking Only orders with tracking numbers are trackable. Signature on delivery may be required for some orders. After your order is dispatched, you will receive a tracking number with your Shipping Confirmation email. Use the tracking notification number to track your parcel at www.canadapost.com, https://tools.usps.com/, or www.royalmail.com. If you are ordering from the USA, you can use the tracking number to track your parcel at www.usps.com after it enters the USA.
Guaranteed Delivery Insurance (Canada & USA only) To guarantee your delivery, you will have the option to purchase a delivery option with insurance (cost of extra CA$15). We’ll resend your order free of charge if it goes missing one time to the same address or a different address if you choose. If you choose the ‘Guaranteed Delivery Insurance’, we guarantee your parcel in the event of it not arriving to you (must be undelivered with tracking after the allowed shipping times), and we will reship your parcel to the original address provided that we do not receive online confirmation of the delivery of your parcel from the mail service. This is our insurance for you in case something happens to your order. If you don’t have insurance from us, we will not reship.
The Delivery Insurance option is available for customers from Canada and USA only. Customers from Canada can add the Delivery Insurance option as an additional product to their cart. Customers from the U.S.A. will be able to select the shipping option with insurance in checkout, within the shipping section. Customers from other regions order at their own risk, and Novelty Gardening Seeds cannot be held responsible for packages missing in the post.
Delivery Issues If you do not receive your goods within the estimated times listed above, please contact your postal service with your tracking number, as they might be holding your package. Once you have done so without success, please contact us; we will make inquiries to try and track down your parcel with the relevant postal service. If we are unsuccessful, then we cannot be held responsible for the mail service, and your quarrel is with them. If you paid for our shipping insurance above, you will get one free reship of your order.
Should you not be at home when a delivery is attempted, your postman will leave a slip through your door, and your package will be returned to your closest main post office, waiting for collection. If you do not collect your parcel, it will be returned to nowhere and it will be lost! So please make sure you purchase shipping insurance, and we will then contact you to confirm that your address details are correct so that we can reship (provided it was caught in Customs and not marked “Undeliverable” by the post office).

5. No Returns, Refunds, or Exchanges – All Sales Final Due to the nature of our products as live/perishable seeds (novelty items subject to germination variability, storage conditions, planting methods, environmental factors, and other variables beyond our control), all sales are final. We do not accept returns, refunds, exchanges, or cancellations for any reason whatsoever once an order has been placed and processed. This includes but is not limited to issues with germination rates, seed viability, appearance, or customer dissatisfaction. By placing an order, you acknowledge and agree to this strict no-return policy.
6. Product Disclaimer and Limitation of Liability Seeds are live products with inherent variability. We make no warranties, express or implied, regarding germination rates, plant health, growth success, or fitness for any particular purpose. Germination and growth depend on factors such as soil, water, light, temperature, storage, and user handling—we provide no guarantee of results.
To the fullest extent permitted by law, Novelty Gardening Seeds shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services, including but not limited to loss of profits, data, or plants. Our total liability shall not exceed the amount paid for the specific product in question.
7. Fraud Prevention and Order Cancellation We take fraud seriously. We reserve the right to:
- Cancel any order suspected of fraud, chargeback abuse, or violation of these Terms without notice.
- Report fraudulent activity to payment processors, law enforcement, or collections agencies.
- Share customer information (name, address, email, order details, payment info) with relevant parties in response to chargebacks, disputes, or investigations.
- Ban repeat offenders from future purchases.
You represent that all payment information provided is accurate, that you are authorized to use the payment method, and that funds are from legitimate sources.
8. Intellectual Property All content on our website (text, images, logos, product descriptions) is owned by Novelty Gardening Seeds or licensed to us and protected by copyright and other laws. You may not copy, reproduce, or use it without written permission.
9. Governing Law and Dispute Resolution These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Ontario. You agree to submit to the personal jurisdiction of such courts.
10. Changes to Terms We may update these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of our website or services after changes constitutes acceptance.
